Welcome to Jennings Photography (accessible at www.jennings.photography). By using this website and booking our photography services, you agree to comply with and be bound by the following Terms of Service. Please read them carefully. If you do not agree with any part of these terms, please do not use our website or services.
1. Acceptance of Terms
By accessing www.jennings.photography (the “Site”) or booking a photography session with Jennings Photography (“Photographer,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service.
2. Services and Booking
Agreements: All photography services, including dates, times, locations, and specific deliverables, will be outlined in a separate written contract or booking confirmation.
Retainer and Payment: A non-refundable retainer fee is required to secure your booking date. The remaining balance is due 30 days before the event.
Cancellations and Rescheduling: If the Client cancels, the retainer is forfeit. Rescheduling is subject to the Photographer’s availability and may incur an additional fee if not requested within 30 days of the scheduled session.
3. Copyright and Image Usage
Photographer’s Copyright: Jennings Photography retains all copyright and ownership of all images taken during the session, in perpetuity, anywhere in the world.
Client License: Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the delivered images for personal, non-commercial purposes (e.g., printing for home, sharing on personal social media).
Restrictions: The Client may not alter, edit, apply filters to, or sell the images. Commercial use requires a separate commercial licensing agreement and additional fees.
4. Model Release
Unless strictly negotiated otherwise in writing prior to the session, the Client grants Jennings Photography the irrevocable right to use, publish, and exhibit the photographs for advertising, marketing, portfolio display, website use, and photography competitions.
5. Delivery and Archiving
Editing and Turnaround: The Photographer will select the best images from the session for editing. Unedited RAW files are not provided to the Client. Turnaround time for final galleries is typically 6-8 weeks, depending on the season and type of shoot.
Archiving: Jennings Photography will maintain the final digital files for 12 months after delivery. It is the Client’s responsibility to download and securely back up their images upon receipt.
6. Website Use and Intellectual Property
All content on www.jennings.photography, including but not limited to photographs, text, graphics, logos, and site design, is the property of Jennings Photography and is protected by copyright laws. You may not download, copy, reproduce, or distribute any content from this Site without prior written consent.
7. Limitation of Liability
Force Majeure: Jennings Photography shall not be liable for failure to perform duties due to events beyond our control, including illness, injury, extreme weather, acts of God, or equipment failure. In such events, a full refund of any monies paid (including the retainer) will be issued.
Data Loss: While we take extreme care with digital files, including multiple backups, in the unlikely event that photographs are lost, stolen, or destroyed, liability is limited to a refund of all payments received or a free reshoot.
General Liability: To the maximum extent permitted by law, Jennings Photography shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our Site or services.
8. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time without prior notice. Any changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site or services after any such changes shall constitute your consent to such changes.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Essex, England, without regard to its conflict of law provisions.
